Debris By-law Information 219-85

The purpose of the Debris By-law is to prohibit the accumulation of litter and debris on all City or private property as well as requiring that dangerous situations such as open pits and wells be protected, filled or drained. It is an offence under the By-law for any private property owner to allow litter and debris to accumulate on private property.

It is an offence to dump any debris on private property without the consent of the property owner or to dump debris on any City property without the consent of the City.

Private property owners who are or have experienced problems with illegal dumping are encouraged to take steps to protect their property from such occurrences. These steps may include posting No Dumping signs or prohibiting access to the property (i.e. vacant properties or properties that are closed overnight).

This By-law also requires that areas on private property with an accumulation of water that is a health or safety hazard be filled or drained. This does not apply to natural ponds or water courses. Further, any dangerous area on a property such as an open pit or well that could constitute a hazard to any person shall be drained or filled in immediately.

In the event that a property owner fails to comply with the provisions of the Debris By-law 219-85, as amended, City staff have the authority to take whatever action is required to remove the debris or fill in or drain a dangerous area or accumulation of water. Any costs associated with the City undertaking any work will be applied to the tax rolls for the subject property.

The maximum fine for non-compliance with the Debris By-law is $5, 000.00.
