Revised Swimming Pool Enclosure By-Law

The new Swimming Pool Enclosure By-law includes a two step process, which consists of taking steps to comply with various City requirements as provided in a 'To-Do' list, and a pool enclosure inspection, whereby if the City deems the pool enclosure safe and in compliance with the By-law specifications, a Certificate of Approval will be issued to the pool owner. Pre pool construction inspections will no longer be conducted.

The 'To-Do' list consists of contact numbers for a variety of City Departments which will need to be contacted by the property owner to ensure, among many things, that the site location of the pool equipment is appropriate. After the pool owner or company representative has contacted all the relevant departments and complied with their requirements, the property owner may proceed to install and erect the pool and pool enclosure.

However, every owner shall ensure that the swimming pool is not filled with water and that no water is allowed to remain in the swimming pool unless a valid Certificate of Approval has been issued for the swimming pool enclosure.

Request for a swimming pool enclosure to seek a Certificate of Approval shall be completed, signed by the property owner and submitted along with the required fee in person, by mail, telephone or electronically through E-City, which will be available soon. A By-law Enforcement Officer will attend at the property to determine whether the swimming pool enclosure complies with all specifications and requirements of the By-law. If the enclosure is not in compliance, a Notice of Contravention listing the deficiencies will be issued to the pool owner. If the enclosure is approved, a Certificate of Approval will be issued by the Manager, By-law Enforcement Section. If at any time the pool enclosure no longer complies with the By-law requirements, the City may revoke the Certificate of Approval, by way of issuance of a Revocation Order.
