Answer
If there are gaps or openings, then it is not a noise barrier, and therefore you have a privacy fence on your property. For fence-related issues, please refer to the City's Fence By-law #397-78 or Division Fence By-law #0075-2004. These by-laws are available at: http://www.mississauga.ca/portal/cityhall/bylaws.
