As of September 2, 2025, the Ministry of the Attorney General will follow a new appeal process. Read the instructions carefully to avoid mistakes that may affect your applications.
The first step to start the appeal process is to complete and file a form called a “Notice of Appeal”.
If your appeal deals with a matter heard under PART I (non parking tickets), PART II (International Pearson Airport M parking tickets) or PART III (summons served notices) of the Provincial Offences Act, you must file the completed Notice of Appeal with the appeal court office at 7755 Hurontario Street, Brampton, Ontario (hours of operation are 9 to 11 a.m. and 2 to 4 p.m.).
Transcripts are a written record of what was said at a court hearing. The appeal rules require you to provide a transcript if a trial was held. Failure to do so may result in your appeal not being scheduled or being dismissed.
If transcripts are required because of a trial or a judge’s order, the person who started the appeal is responsible for ordering and paying for three (3) copies of all transcripts and for giving a copy to the other side and the court.
Order your transcripts at Order Court Transcripts
Once you have completed your transcript order you will need to provide proof of receipt to the Appeal Court.
Once you have received your three (3) copies of the transcripts you will need to serve the Prosecution Office (950 Burnhamthorpe Road West, Mississauga, Ontario) and Appeal Court (7755 Hurontario Street, Brampton, Ontario, hours of operation are 9 to 11 a.m. and 2 to 4 p.m.).
If you do not file a Notice of Appeal within thirty (30) days, you must get judicial permission to file the Notice of Appeal by completing the forms Notice of Motion with the General Form Affidavit.
Get a copy of your file from 950 Burnhamthorpe Road West, Mississauga, Ontario Provincial Offence Office (hours of operation for an appeal are 8:30 a.m. to 4 p.m.).
To ask for this judicial permission, complete and file forms called “Notice of Motion with the General Form Affidavit”. In the forms, you must explain why you did not file the Notice of Appeal within the thirty (30) day period. You can get the Application of Notice of Motion with the General Form Affidavit at the Appeal Court office at 7755 Hurontario Street, Brampton, Ontario (hours of operation are 9 to 11 a.m. and 2 to 4 p.m.) to complete your application.
